Please read section 4 before using this application. QuestGun contains no games and no game data. It cannot do anything until you supply files yourself, and you are solely responsible for the legality of the files you supply.


1. Agreement

These Terms and Conditions ("Terms") form an agreement between you and SludgeSoft ("we", "us") governing your use of the QuestGun application ("QuestGun", "the Application").

By installing or using QuestGun you accept these Terms. If you do not accept them, do not install or use the Application, and uninstall it if you already have.

These Terms are in addition to, and do not replace, the terms of the store from which you obtained QuestGun.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use QuestGun on virtual reality hardware you own or control, for your own personal, non-commercial use.

You may not:

3. What QuestGun is

QuestGun is a frontend. It provides a virtual environment, a virtual screen and lightgun-style aiming, and it hosts emulator "core" libraries that are loaded at runtime.

QuestGun is not an emulator, and it contains no emulator. It contains no games, no game data, no ROM images, no disc images, no BIOS or firmware images, and no copyrighted material belonging to any hardware or software rights holder. The built-in demo range is drawn procedurally by the Application from our own original artwork; it emulates nothing and loads no files.

4. Content is supplied by you, and is your responsibility

Apart from a built-in demo range which is our own original work, QuestGun ships with no content. To play anything else you must obtain and install two things yourself: emulator core files, and game data.

You are solely responsible for the emulator cores, game data, BIOS or firmware images and any other files you obtain, install or use with QuestGun, and for ensuring that you have the lawful right to possess and use each of them.

Copyright law relating to game software, BIOS images and firmware varies considerably between countries, and is not always intuitive. Owning original hardware or an original copy of a game does not automatically grant you the right to possess or create a digital copy of it in every jurisdiction.

We do not supply, host, link to, endorse, or assist in obtaining any game data, BIOS image or other copyrighted material, and we will not do so. Any request for such material will be declined.

If you are in any doubt about the legal position where you live, obtain your own legal advice before using the Application. Your use of QuestGun with content you are not entitled to use is a breach of these Terms and is entirely at your own risk.

5. Third-party software

Emulator cores loaded by QuestGun are independent third-party software. They are not written, supplied, controlled, endorsed or warranted by us, and they are governed by their own licences — many of which, including those of the libretro project cores, are open-source licences such as the GNU General Public Licence.

You are responsible for complying with the licence terms of any core you install. We accept no responsibility or liability for the behaviour, quality, legality or safety of third-party cores.

Virtual reality carries risks that conventional screens do not. Before using QuestGun:

QuestGun is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including without limitation any implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that QuestGun will be uninterrupted, error-free or free of defects, that it will run any particular emulator core or item of game content, that it will achieve any particular level of performance or frame rate, or that any defect will be corrected.

QuestGun is software in active development. Some content will run poorly or not at all, and features may change or be removed between versions.

8. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of profits, revenue, data, goodwill, or anticipated savings, arising out of or in connection with your use of, or inability to use, QuestGun — whether in contract, tort (including negligence), breach of statutory duty or otherwise, and whether or not we were advised of the possibility of such loss.

To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with these Terms or your use of QuestGun shall not exceed the greater of the amount you actually paid for the Application, or £10 GBP.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you deal as a consumer, your statutory rights are unaffected.

9. Indemnity

You agree to indemnify and hold us harmless against any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Application, or your obtaining, possession or use of any emulator core, game data, BIOS image or other content in connection with the Application.

10. Trademarks and no affiliation

QuestGun is an independent work. It is not affiliated with, endorsed by, sponsored by or associated with Meta Platforms, Inc., the libretro project, the MAME project, or any manufacturer, publisher or rights holder of any arcade machine, games console, game, or peripheral.

All trademarks, trade names, product names and logos referred to in the Application or its documentation are the property of their respective owners, and are used only for the purpose of identification and description — nominative fair use — and never to imply any endorsement or association.

11. Termination

This licence terminates automatically if you breach these Terms. We may also cease to make the Application available, or discontinue it, at any time. On termination you must stop using QuestGun and uninstall it. Sections 4, 5, 7, 8, 9, 10 and 13 survive termination.

12. Changes to these Terms

We may update these Terms from time to time. The "last updated" date above will change, and material changes will be noted in the release notes for the version in which they take effect. Continuing to use QuestGun after a change takes effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction, save that if you are a consumer resident elsewhere you retain the benefit of any mandatory protections of the law of your country of residence, and may bring proceedings in your local courts where the law entitles you to do so.

14. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. Our failure to enforce any provision is not a waiver of it. These Terms constitute the entire agreement between you and us in relation to QuestGun.
